The two new decisions taken by the Board of Appeal related to vertebrate testing in Reach on ingredients exclusively used in cosmetics (several toxicity tests and a fish sexual development test), are among the most important decisions taken to date.
For toxicity tests the argument is that REACH Regulation does not contain an automatic exemption from test requirements for registration due to the exclusive use as ingredient in cosmetics.
For the fish sexual development test, ECHA required this test according to column 2 of section 9.1 of Annex IX, because the substance may be an endocrine disruptor.
